Chapter 7

Chapter 7 Bankrupcy

Chapter 7 Bankruptcy may result in a "discharge" your debt.  Not all debts may be discharged however.

Debts generally eligible for discharge include:

  • Home foreclosure debt
  • Automobile repossession debt
  • Medical bills
  • Credit card debt
  • Garnishments
  • Other non-priority, unsecured debts

Debts generally not eligible for discharge include:

  • Student loans
  • Most tax debts
  • Child support
  • Most traffic tickets and Criminal Fines
  • Injuries caused by drunk drivers

You get to keep some assets that are exempt, such as: tools used for your job, some household furniture/personal car or truck/jewelry to a certain value, household appliances, home equity to $125k, and more.

If you have income, the "means" test will be applied to determine whether you may file for Chapter 7.

You must obtain credit counseling from an approved provider within 180 days before filing a case or case will be dismissed.  Our office will provide you a code to enter when registering for the online counseling.

After your attorney files the Chapter 7 case, you must complete a second mandatory seminar called "Debtor Education".  We will again provide you a code.

Most Chapter 7 cases conclude around 3 to 4 months after filing.

    Filing Fee:  $335.00
